PAGAMENTI
Il pagamento s’intende per pronta cassa e cioè un terzo all’atto della commissione e la rimanenza contro assegno ferroviario. I prezzi s’intendono per merce franco nostri Stabilimenti Milano.

Tutte le biciclette portanti la nostra marca sono vendute con garanzia di dodici mesi, dalla data di uscita dai nostri magazzini, per i vizi di costruzione risultanti da difetto di materiale o di fabbricazione. Questa garanzia è limitata esclusivamente alla riparazione gratis del pezzo difettoso, reso franco di spesa al nostro stabilimento in Viale Abruzzi, 16. Verranno fatturate le eventuali spese di smontaggio e montaggio.

La suddetta Casa però non garantisce i tubolari, le smontabili, sezione un quarto e le camere d’aria montate su cerchi di legno.

Ogni bicicletta sarà munita di un attestato di garanzia da noi firmato che non sarà valido se non sarà controfirmato da un nostro Agente esclusivo.

Non ritirare la bicicletta se non accompagnata dall’attestato di garanzia. Esigere su ogni bicicletta le nostre marche di fabbrica depositate in tutto il mondo.

Le nostre biciclette si forniscono anche col mozzo “Torpedo„ a freno contropedale e ruota libera, tipo Campione del mondo, della Casa Fichtel Sachs Akt. Ges. di Schweinfurt a/Main.

Verificare che il numero della bicicletta corrisponda a quello riprodotto in perforazione sull’Attestato di Garanzia.

Autorevoli giudicati anche della Suprema Corte hanno statuito :

1) Che per integrare i reati di cui agli art. 296 e 297 del codice penale, che puniscono le contraffazioni e l’uso dei marchi e lo smercio dei prodotti contraffatti, È SUFFICIENTE LA RIPRODUZIONE DEI TRATTI CARATTERISTICI SALIENTI DEL MARCHIO E NON LA COMPLETA IMITAZIONE.

2) CHE A NULLA SERVE IL CAMBIO DEL NOME DEL PRODUTTORE E DEL LUOGO DI PRODUZIONE QUANDO L’INSIEME DEL MARCHIO È CONTRAFFATTO IN MODO DA INGENERARE EQUIVOCO ED IL POSSIBILE INGANNO DEL COMPRATORE.

3) Che il venditore di merci che portano il marchio contraffatto È RESPONSABILE DEL REATO DI CUI ALL’ARTICOLO 297 C. P. cioè vendita di merce contraffatta ANCHE SE DICHIARI ALL’ACQUIRENTE LA VERA ORIGINE DEL PRODOTTO VENDUTO.

In conseguenza la Casa Bianchi, che è presa particolarmente di mira dai contraffattori del marchio,

non soltanto e specialmente i fabbricanti delle decalcomanie che riproducono il marchio contrafiatto — bensì i venditori delle decalcomanie stesse — coloro che le detengono in qualsiasi modo — coloro che ne fanno uso e che vendono le biciclette col marchio contraffatto — coloro che ne fanno acquisto — con avvertenza che contro di loro sarà proceduto con la massima severità e con immediata denuncia all’Autorità giudiziaria.

La Ditta richiama l’attenzione dei suoi Agenti in Italia e fuori perchè siano combattute senza quartiere queste forme mancine della concorrenza sleale che arrecano gravi danni alle Ditte ed al buon nome del nostro paese.
