Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Anschutz Media Inc. of California, USA, which runs Ebykr (ebykr.com) (“Ebykr”, “we”, “us” or “our”). They cover the website, its forum and comments, the archive and its contribution forms and The Ebykr Digest newsletter (together, the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use Ebykr

You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use the Service only with the permission of a parent or guardian, who agrees to these Terms on your behalf.

2. Accounts

  • Give accurate information when you register and keep it current.
  • An account is for one person. Keep your password confidential; you are responsible for everything done under your account. Tell us at once if you suspect someone else is using it.
  • If you use Sign in with Google, Google’s own terms also apply to that sign-in.
  • We may suspend or close any account that breaks these Terms or is used for spam or abuse, without notice. You may close your account at any time by asking us.

3. Ebykr’s content

  • Articles and Ebykr’s own work. The articles, timelines, guides, transcriptions, translations, descriptions, photographs and graphics created for Ebykr are © Anschutz Media Inc., all rights reserved, unless a page says otherwise. You may read, print or save pages for your own non-commercial use, link to any page and quote short passages with credit to Ebykr and a link to the page. Any other copying, republication, translation or commercial use needs our written permission.
  • Openly licensed data. Where a page states a license, that license governs the material it names. The Serial Registry data, for example, is published under the Creative Commons Attribution-NonCommercial 4.0 International license.
  • Archive documents. The catalogs, advertisements, posters, magazine covers and other period documents in the archive were created by their original publishers. Many are in the public domain; others belong to rights holders who may be unknown. Ebykr claims no ownership of these documents and grants no license to them. Each record names its publisher and source where they are known. Any reuse of the documents themselves is your responsibility.
  • Names and trademarks. Maker names, logos and marks belong to their owners. Ebykr uses them to identify and document bicycles and components and is not affiliated with or endorsed by any maker unless a page says so. The Ebykr name and logo are ours.

4. Automated access

  • Crawlers, search engines, AI assistants and other automated tools may access Ebykr only as our robots.txt file permits and only at a rate that does not slow or burden the site.
  • Do not get around rate limits, blocks, sign-in requirements or other access controls, and do not disguise automated access as a person’s browser.
  • Do not collect personal information about members, such as names, email addresses or profiles, by any means.
  • Permission to crawl covers indexing pages and citing them with a link. It is not a license to reuse the content: copying, mirroring or republishing Ebykr’s articles, photographs or archive images in bulk, or building a collection or database from them, needs our written permission, except as a license stated on a page allows.

5. What you contribute

“Contributions” means anything you post or send through the Service: comments, forum posts, Bicycle Marketplace listings, profile details, Serial Registry entries, Submit Your Bike entries, Docs Drop uploads, messages and photographs.

  • You keep ownership of your Contributions.
  • License to us. You grant Anschutz Media Inc. a perpetual, irrevocable, worldwide, royalty-free, non-exclusive and transferable license to use, reproduce, modify, adapt, translate, publish, distribute and display your Contributions and to make works based on them, in any media now known or later developed, and to sublicense these rights, including by publishing Contributions, or information drawn from them, under open licenses such as Creative Commons. This license continues after you stop using the Service or close your account. If you ask us to remove your personal details, we will (see our Privacy Policy), and we may keep the factual information from a Contribution without them, such as a serial number or a specification.
  • Credit. We credit a published Contribution as you choose: your name, a handle or none. We may decline a credit line that is offensive or promotional.
  • Your promises. By submitting a Contribution you confirm that you own it or have permission to share it, including every photograph and scan; that it is accurate to the best of your knowledge; and that it does not infringe anyone’s rights, does not break the law or these Terms and does not include anyone else’s personal information without their permission.
  • Moderation. We review Contributions and may edit, decline or remove any of them at any time, without giving a reason. Publication is not guaranteed and Contributions are not paid for.
  • AI-made material. Identify any Contribution made in substantial part with AI tools. Never submit an image generated or materially altered with AI or editing software as a genuine photograph or period document.
  • Suggestions. If you send us ideas or suggestions, we may use them freely and owe you nothing for them.

6. Community rules

In comments, the forum and every other Contribution, do not:

  • harass, threaten, insult or impersonate anyone;
  • post hateful, obscene or sexually explicit material;
  • post spam or advertising, except your own listings in the Bicycle Marketplace forum;
  • post anything unlawful, defamatory or infringing on someone else’s rights;
  • post someone else’s personal information without their permission;
  • post malicious code or deceptive links;
  • open another account to get around a suspension.

Keep discussion civil and on topic. We may remove anything and suspend any member, at our discretion.

7. Bicycle Marketplace

Listings in the Bicycle Marketplace forum are made by members, and every sale is between the buyer and the seller. Ebykr is not a party to any sale and does not check listings, items, buyers or sellers. We are not responsible for any payment, delivery, item or dispute. List only items you own and have the right to sell, describe them honestly and never list stolen or illegal goods. Deal with care and at your own risk.

8. Information on Ebykr

Ebykr publishes historical research. Dates, attributions, specifications and serial-number readings are our best reading of the sources available to us; they may be incomplete or wrong, and new evidence can change them. Nothing on Ebykr is professional, mechanical, safety, valuation or investment advice. Old bicycles and components can fail: have a qualified mechanic inspect any vintage bicycle before you ride it. If you find an error, please tell us.

9. Links to other sites

Ebykr links to many other websites, including on our Links page. We do not control them and are not responsible for their content, practices or availability. A link is not an endorsement.

10. Copyright and other rights complaints

If you believe material on Ebykr infringes your copyright or other rights, including an archive document you hold the rights to, email eabykr@gmail.com with the subject “Rights issue” or write to us through our contact form, and include:

  • the work and your rights in it;
  • a link to each page on Ebykr where the material appears;
  • your name and contact details;
  • a statement that you believe in good faith the use is not authorized, that the information in your notice is accurate and that you are the rights holder or are authorized to act for them.

We review every notice and remove or correct material where appropriate, including correcting a credit. We may tell the person who submitted the material. We close the accounts of members who repeatedly post infringing material.

11. The Ebykr Digest

The Ebykr Digest is free and is sent only to subscribers who have confirmed their address. You can unsubscribe at any time with the link in every issue.

12. Disclaimer of warranties

THE SERVICE AND EVERYTHING ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS.

13. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, ANSCHUTZ MEDIA INC. AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, ANY CONTRIBUTION OR ANY DEALINGS BETWEEN MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). Some places do not allow these limits, so they apply to you only as far as the law where you live allows.

14. Indemnity

You agree to indemnify, defend and hold harmless Anschutz Media Inc. and its officers, employees and agents against any claim, loss or cost, including reasonable legal fees, arising from your Contributions, your use of the Service, your breach of these Terms or your dealings with other members.

15. Ending your use

You may stop using the Service at any time and ask us to close your account. We may suspend or end your access at any time if you break these Terms or to protect the Service or its members. Sections 3, 5, 7, 8, 12 to 16 and 18 continue to apply after your use ends.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its rules on conflicts of law. Any dispute about these Terms or the Service will be decided only by the state or federal courts located in California, and you agree to their jurisdiction.

17. Changes to these Terms

We may change these Terms. We post the new version here with a new “Last updated” date and note significant changes on the site. If you keep using the Service after a change takes effect, you accept the new Terms.

18. General

These Terms, the Privacy Policy and any license stated on a page are the whole agreement between you and us about the Service. If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a part of these Terms, we have not given up the right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours to a new owner of Ebykr.
